Terms and Conditions
Please read
Below you will find the terms of use for our hotel's website. We encourage you to read them carefully so that using the service, making reservations, and contacting our facility are as clear and comfortable for you as possible.
TERMS OF STAY
If you cancel on the arrival date, we retain 100% of the price.
s are gross prices for private individuals and include 8% VAT. To ensure a smooth stay, please follow our terms.
1. Our apartments can be booked:
- By phone,
- Via www.flatbook.pl,
- By e-mail,
- Through intermediary sales portals: Booking, Airbnb, Expedia, Noclegi (booking terms may differ).
2. Booking a stay means accepting the Terms and Conditions.
3. Your booking will be confirmed by e-mail to the address provided or by an internal message via an intermediary platform.
2. Fees and deposit
Apartment fees depend on the selected rate plan and location.
Gdańsk, Sopot, Gdynia
- Refundable plan
Pay a 30% deposit within 48 hours of booking. No payment = booking cancellation.
Pay the remaining 70% 7 days before arrival. No payment = booking cancellation and retention of the deposit.
If booking less than 7 days before arrival, pay 100% at booking. No payment = booking cancellation.
For free cancellation, notify us no later than 7 days before arrival; we will refund all amounts paid.
If you cancel less than 7 days before arrival, we retain 100%.
- Flexible plan
Pay a 30% deposit within 48 hours of booking. No payment = booking cancellation.
Pay the remaining 70% 7 days before arrival. No payment = booking cancellation and retention of the deposit.
If booking less than 7 days before arrival, pay 100% at booking. No payment = booking cancellation.
For free cancellation, notify us no later than 3 days before arrival; we will refund 100%.
If you cancel later than 3 days before the stay, we retain 100%.
- Non-refundable plan
Pay 100% within 48 hours of booking. No payment = booking cancellation.
If booking less than 7 days before arrival, pay 100% at booking. No payment = booking cancellation.
If you cancel, we retain 100%.
MIERZEJA WIŚLANA
- Partially refundable plan
Pay a 50% deposit within 48 hours of booking. No payment = booking cancellation.
Pay the remaining 50% 7 days before arrival. No payment = booking cancellation and retention of the deposit.
If booking less than 7 days before arrival, pay 100% at booking. No payment = booking cancellation.
If you cancel no later than 1 day before arrival, we will refund 50% of the price at booking. No payment = booking cancellation.
For free cancellation, notify us no later than 3 days before arrival; we will refund 100%.
If you cancel later than 3 days before the stay, we retain 100%.
- Non-refundable plan
Pay 100% within 48 hours of booking. No payment = booking cancellation.
If you book an apartment less than 7 days before arrival, pay 100% at booking. No payment = booking cancellation.
If you cancel, we retain 100%.
3. If you need a VAT invoice, tell us when booking. Without this information, issuing a VAT invoice later will not be possible.
4. We may collect a deposit to cover possible damage; we will notify you by separate e-mail. You may pay it by bank transfer or via Przelewy24. We will return it within 14 days after your stay. We may deduct damage costs and contractual penalties specified in the Terms and Conditions.
The price includes:
- bed linen and towels,
- final cleaning for normal soiling,
- utilities (water, electricity, gas and, in selected apartments, wireless Internet).
Additional services: pet stay (dogs and cats): 100 zł per stay, only in selected apartments; linen and towel change during the stay—price set individually based on the number of guests; stay cleaning—price set individually based on apartment location.
3. Complaints
To submit a complaint:
- send complaints about bookings or payments to: reklamacje@flatbook.pl,
- complaints may be submitted within 30 days of check-out,
- we will review them within 14 days.
4. Hotel night
- Apartment rental is calculated by nights.
- Reservations must be for at least one night.
- For apartments in the Tri-City, the hotel night starts at 15:00 on arrival day and ends at 11:00 the next day; for apartments on the Vistula Spit, it starts at 16:00 and ends at 10:00 the next day.
- If you do not leave by the specified time, we will charge a contractual penalty of 150.00 zł for each started 30-minute period.- You may extend your stay only with our consent; request this by phone or e-mail by 9:00 on your departure day.
- We will extend your stay subject to availability, but cannot guarantee it.
- Extending your stay by another night incurs fees, which we will present to you.
Important: if damage or abnormal soiling prevents us from accepting subsequent guests on your check-out day, we may charge a contractual penalty equal to twice the apartment’s nightly price.
5. Withdrawal from the Agreement, apartment change
You have no right to withdraw from a distance contract when making a reservation, i.e. entering into an agreement with us (under Article 38(12) of the Act of 30 May 2014 on Consumer Rights).
We may withdraw from the Agreement and refuse to provide the apartment if:
- you do not pay the full stay price,
- you do not complete the registration card or provide false details,
- persons staying in the apartment are under the influence of alcohol or drugs,
- they behave aggressively,
- they seriously breached the stay rules during a previous stay.
We may withdraw from the Agreement and order you to leave if you or your guests:
- disturb the peace or quiet hours and the Police or neighbours intervene,
- damage the apartment,
- behave aggressively.
If we withdraw from the Agreement for the above reasons, we are not required to refund any payments.
We may change the reserved apartment to one of a similar or higher standard at the same price.
If unforeseeable circumstances prevent us from offering the reserved apartment or another of the same or higher standard:- we may offer you another apartment of a lower standard, with an appropriate price adjustment,- if you do not agree to this solution, you may withdraw from the agreement and request a refund of the amounts paid by you.
6. What can we do?
We may enter the apartment without prior notice when:
- a failure has occurred,
- there is a suspicion that you are seriously violating the house rules or damaging the apartment,
- there is a risk to life or property,
- you fail to leave the apartment (including taking all your belongings) after check-out time and do not extend your stay in accordance with the “Hotel day” section. In this case, we will also charge a contractual penalty of PLN 150 for each commenced half-hour of occupying the apartment after the scheduled check-out time (also if belongings are left in the apartment). In the above situations, we will also call the Police or other services.
We are not liable:
- for property or personal damage suffered by you or your guests,
- for items brought into and left in the apartment after you leave. We may return items left behind at your expense; however, if you do not collect them, we will dispose of them at your expense after 7 days.
7. What you may not do
You may not:
1. Use the apartment contrary to its intended purpose,
2. Bring in more guests than the number declared when booking,
3. Sublet the apartment or make it available free of charge to any third party,
4. Alter the apartment’s structure, carry out renovations, modifications or changes to its arrangement,
5. Drill holes in the walls,
6. Smoke in the apartment, except on the balcony/terrace, provided that smoke does not enter the apartment and this does not conflict with the rules of the building, owners’ association or cooperative,
7. Throw cigarette butts, ash, rubbish or any other items from windows, balconies or terraces,
8. Keep animals in the apartment unless you have obtained our consent and paid the fee,
9. Organise parties, celebrations or receptions that violate public-order rules or quiet hours,
10. Use any electrically powered devices other than: computer, electric shaver, hairdryer, phone charger, kettle, toaster, iron and TV,
11. Disturb the peace during the day or the quiet hours in force from 22:00 to 6:00.
8. Your obligations
You must:
- complete the registration card before checking into the apartment,
- take care of the apartment,
- immediately report any damage that has occurred,
- remain quiet during the day and observe quiet hours,
- provide us access to the apartment in the situations described in the House Rules,
- if staying with an animal, have a health booklet confirming current vaccinations,
- secure the apartment when leaving it: close windows, turn off taps, electricity and electrical devices,
- secure property brought into the apartment (there is no safe in the apartment).
9. What happens if you do not comply with the House Rules
If you fail to comply with the House Rules:
1. We may withdraw from the Agreement and require you to leave the apartment, without any right to a refund,
2. We may also independently claim a contractual penalty from you for violations, in the following amounts:
– PLN 150 – for each destruction of or damage to textiles (e.g. curtains, bedspreads, towels);
– PLN 200 – for:
· loss or destruction of a SPA or apartment access card;
– PLN 500 – for:
· loss or destruction of the chip/remote control for the garage entrance gate or stairwell entrance,
· emergency door opening, e.g. if you lose or damage keys/card, or fail to return the key/card by check-out,
· each destruction of or damage to pots, pans or tableware,
· each destruction of or damage to decorative items (e.g. paintings, clocks, plants),
· violating the smoking ban, or if your actions (or those of your guests) trigger the fire alarm system or result in the Fire Brigade being called; throwing cigarette butts, ash, rubbish or other items from windows, balconies or terraces,
· violating public-order rules, daytime peace or quiet hours, in particular by organising parties, celebrations or social receptions,
· each violation of the House Rules;
– PLN 1,000 – for each destruction of or damage to:
· interior doors (including forcing the lock),
· small household appliances (e.g. coffee machine, kettle, mixer, toaster, blender, etc.),
· lighting elements;
– PLN 1,000 – for violating the ban on keeping animals;
– PLN 1,500 – for each destruction of or damage to:
· mattresses,
· sanitary fixtures (e.g. bathtub, washbasin, toilet, shower enclosure);
– PLN 2,000 – for each destruction of or damage to:
· walls,
· floors,
· ceiling,
· tables, chairs, wardrobes, cabinets, coffee tables and other furniture,
· exterior doors (including forcing the lock),
· any large household appliance or audio/video equipment;
– PLN 2,500 – for each destruction of or damage to (including irremovable staining):
· upholstered furniture—sofas, couches, beds and armchairs.
3. We may claim damages from you exceeding the contractual penalty.
10. Other provisions
1. Matters not regulated by these House Rules are governed by the relevant provisions of Polish law.
2. The competent court is the court in Gdańsk.
3. We may amend these House Rules; however, bookings made before an amendment are subject to the version in force when the booking was made.
4. In the event of force majeure, such as a natural disaster, strike or state of emergency, preventing or excessively hindering performance of the agreement, neither party shall be liable for non-performance or improper performance of its obligations.
